Proposition 215 is known as the California Compassionate Use Act.
Prop 215 took effect in November 1996 as CA Health and Safety Code 11362.5. Prop 215 removes criminal penalties for medical marijuana patients who hold a valid physician’s recommendation or approval to use medicinal cannabis. As an approved patient, under Prop 215 you can not be criminally prosecuted for personal use, possession and cultivation of marijuana for medical use by patients.
Designated primary caregivers are also covered under Prop 215, and the caregivers can not be criminally charged for the cultivation of marijuana for medicinal purposes.
